MIMAKI AUSTRALIA PRODUCT WARRANTY

1. AUSTRALIAN CONSUMER LAW

The express warranties specified in this Mimaki Australia Product Warranty are in addition to any rights that an End User has under the consumer guarantees in the Australian Consumer Law,

2. STANDARD WARRANTY

2.1 Mimaki Australia warrants, subject to the exclusions set out in clause 4 (“Exclusions”), that all Products purchased by the End-User in Australia will be free from defects in materials and workmanship for a period of one (1) year from the date of installation (“Standard Warranty Period”), provided that:
(a) the Product was purchased from Mimaki Australia directly or from an authorised Mimaki Australia dealer (“Dealers”) only;
(b) the Product was correctly installed by a Mimaki Australia authorised technician and an installation report (“Installation Report”) was submitted to Mimaki Australia within seven (7) days of their installation;
(c) the Product was used under normal operating conditions for which the Product was intended as detailed in the user manual; and
(d) the warranty claim was received by the Dealer and approved by Mimaki Australia, or the warranty claim was received and approved by Mimaki Australia.

"End-User" is any person that acquires the Products other than for the purpose of resale.

"Product" means the products identified in column 1 of the table in clause 3.3 ("Pricing Table"), as updated or revised from time to time.

2.2 Mimaki Australia makes no warranty or representation, implied or otherwise, that:
(a) the Product will meet the End-User’s specific requirements;
(b) the operation of the Product will be secure, uninterrupted or error-free; or
(c) all defects not affecting performance in the Product will be corrected.

2.3 Subject to the above, the Standard Warranty Period of the Products in the CG Series is two (2) years.

2.4 To enable Mimaki Australia to process the warranty claim efficiently, it is required that the End-User register the Product by completing the Warranty Registration Form in Mimaki Australia website, www.mimakiaus.com.au, within thirty (30) days from the date of installation.

2.5 Warranty Service
(a) During the Standard Warranty Period, Mimaki Australia agrees to, at Mimaki Australia’s option and free of charge, repair or replace all or any part of the Products found to be defective in workmanship or material by Mimaki Australia or its Dealer.
(b) Mimaki Australia will not provide loaner units for warranty repairs.
(c) If the Product is replaced, the defective original must be delivered to Mimaki Australia within thirty (30) days of receipt of the replacement at the End-User’s costs. If the defective Product is not returned within the specified period, the End-User will be invoiced at Mimaki Australia’s recommended retail price for the replacement.
(d) Warranty repair or replacement does not extend the warranty period of the Product.
(e) If the Product subject to the Standard Warranty is located outside the metropolitan boundary defined in clause 8, the End-User shall bear the reasonable travel and accommodation costs of the Mimaki Australia authorised technician attending to the onsite warranty repairs.

2.6 Parts purchased and installed after Standard Warranty Period

All parts purchased and installed after the expiration of Standard Warranty Period are warranted for a period of ninety (90) days from the date of installation, subject to the Exclusions.

2.7 Accessories, Optional Items and Consumables
(a) Defect/Dead on Arrival (“DOA”) Warranty
 (i) Accessories, optional items and consumables attached to the Product at installation may, at Mimaki Australia’s option, be repaired or replaced free of charge to the End-User, provided that:
  (A) the End-User reports any defect in the accessories, optional items and consumables to Mimaki Australia as soon as reasonably practicable but no later than three (3) days after the Product has been installed for the first time; and
  (B) Mimaki Australia approves the End-User’s defect claim after considering and if necessary inspecting the defect reported by the End-User.

(b) The Lamp Warranty
 (i) The Lamp Warranty is defined in Appendix 2.


3. TOTAL CARE WARRANTIES AND PARTS WARRANTY

3.1 Total Care Warranties
(a) 1-Year Total Care Warranty and 2-Years Total Care Warranty (collectively “Total Care Warranties”) are optional extensions of warranty available to cover the End-User against defects in materials and workmanship (subject to the Exclusions contained in clause 4) after the expiration of the Standard Warranty Period.
(b) The End-User can purchase a Total Care Warranty at the fees specified in clause 3.3 (“Pricing Table”) below.
(c) The duration for a Total Care Warranty will be, at the End-User’s choice, either one (1) year or two (2) years from the expiry date of the Standard Warranty.
(d) A Total Care Warranty may be purchased at any time during the Standard Warranty Period but at least one (1) month before the expiration of the Standard Warranty Period. All claims under the Total Care Warranties must be received and approved by Mimaki Australia and are subject to the End-User complying with clause 2.1(a) to (d).
(e) The Total Care Warranties include,
 (i) on-site repair services with labour and parts;
 (ii) engineering hardware updates;
 (iii) firmware and Software maintenance updates; and
 (iv) preventive maintenance carried out on the following timing after expiration of the Standard Warranty Period:
  (A) 1-Year Total Care – 12th month; and
  (B) 2-Years Total Care – 12th and 24th months.

3.3 All of the standard terms and conditions of the Standard Warranty, including the Exclusions contained in clause 4, apply to the Total Care Warranties, and the Parts Warranty.

3.4 Total Care Warranties and Parts Warranty are non-transferable unless approved in writing by Mimaki Australia.



4. EXCLUSIONS


Mimaki Australia Product Warranty does not cover:

(a) Loss or damage to Product due to:
 (i) abuse, tampering, negligence and/or misuse (including accident, electric current fluctuation, improper installation and / or re-location, improper and /or incomplete product maintenance, improper storage, exposure to moisture, excessive temperature, interference by foreign objects, sand, dust, dirt, insect, vermin, or other environmental conditions, and failure to follow precautions or proper operating instructions stated in the Mimaki instruction manual, user guides or other documentation for the Product);
 (ii) repair, upgrade and/or alteration effected by anyone other than a service representative qualified and authorised by Mimaki Australia who is acting in accordance with Mimaki Australia’s service standards and procedures;
 (iii) fire, flood, lightning strike or other acts of God; and
 (iv) deficiencies in consumable parts such as battery leakage; and
 (v) damage caused by head strike or media jam ( any contact of print head or carriage with media ).

(b) Defects, damages or accidents due to the malfunction, connection to or use of unauthorised parts and any third party product (including reconditioned, tampered, reused or non-genuine Mimaki accessories, consumable items not recommended by Mimaki Australia, and any third party hardware or software). In such event, Mimaki Australia reserves the right to cancel the warranty coverage immediately;

(c) Consumable items (listed in Appendix 1), accessories and optional items unless they are DOA (Dead/Defect on Arrival);

(d) Software drivers, utility program and application software supplied with the Product;

(e) Non-Mimaki Products and software items and any other peripherals used in connection with the Product; and

(f) A Product with its serial number or original identification marks removed, defaced or altered.

(g) Electrical Tagging: the End-user at its own cost is responsible for the retesting and retagging of the Product in accordance with the Australian Standards requirements.



5. GOVERNING LAW


5.1 This agreement is governed by and construed in accordance with the laws of the State of New South Wales and Mimaki Australia and the End-User submits to the exclusive jurisdiction of the courts of that State.




6. DISCLAIMER


6.1 To the extent allowed by applicable law:
 (a) the express warranties specified in this Mimaki Australia Product Warranty are in lieu of all other warranties, express or implied, given by any person with respect to the Products: and
 (b) no other warranties shall bind Mimaki Australia or any service provider including the Dealers.

6.2 Mimaki Australia neither assumes nor authorises the Dealer to assume for it any other obligation or liability or make any other warranty in connection with any product without Mimaki Australia’s prior written consent.

6.3 Except for any rights under statute (such as the Australian Consumer Law) which may not be excluded:
 (a) the remedies under this Mimaki Australia Product Warranty are the End-User’s sole and exclusive remedies; and
 (b) Mimaki Australia shall not be liable for loss of data or any incidental, special, economical, indirect or consequential damages (including loss of anticipated benefits or profits to Dealer or End-User) whether based on contract, tort or otherwise,

relating to or arising out of the use of the Products.



7. REMEDIES UNDER THE AUSTRALIAN CONSUMER LAW


7.1 Mimaki Australia's liability to End-Users who claim a breach of the Australian Consumer Law is limited, at Mimaki's option, to the:
 (a) replacement of the Product or the supply of an equivalent product;
 (b) repair of the Product;
 (c) payment of the cost of replacing the Product or of acquiring an equivalent product; or
 (d) payment of the cost of having the Product repaired.
